Description
George Silver was convicted by a jury of offering a bribe to a public official in violation of 18 U.S.C. § 201(b)(3). On appeal, he contends that his motion to dismiss the indictment was improperly denied because (a) the indictment lacked sufficient allegation of specific intent to induce unlawful action by a public official, as required by the statute, and (b) the indictment did not fairly apprise him of the accusations against him, in that it alleged he sought to induce a public official "to do and to omit to do an act" in violation of the law. Silver also claims that it was error to admit testimony concerning an alleged prior attempt to bribe another official, citing the rule against admitting evidence of "other crimes" as tending to prove a general criminal disposition. We find no merit in these contentions and affirm.
